Access to and use of the Titanic Archive website and content provided on these pages is on these terms of use.
Access to and use of www.titanicarchive.org and content provided on these pages is provided by Titanic Archive on the following terms:
- By using www.titanicarchive.org you agree to be bound by these terms, which shall take effect immediately on your first use of www.titanicarchive.org. If you do not agree to be bound by all of the following terms please do not access, use and/or contribute to www.titanicarchive.org.
- Titanic Archive may change these terms from time to time and so you should check these terms regularly. Your continued use of www.titanicarchive.org will be deemed acceptance of the updated or amended terms.
- If there is any conflict between these terms and specific local terms appearing elsewhere on www.titanicarchive.org then the latter shall prevail.
Permitted Uses
We encourage you to use www.titanicarchive.org to extend your knowledge of the Titanic and its topics. Materials in Titanic Archive's collections fall into two categories:
- Items Titanic Archive believes to be in the public domain, or those to which Titanic Archive waives any copyright it might have
- Items Titanic Archive knows to be under copyright or other restrictions
Public Domain and Open Access Policy
Titanic Archive adopts an Open Access policy, which makes transcripts and images of materials it believes to be in the public domain widely and freely available for unrestricted use.
The text, images, trademarks, data, audio files, video files and clips, software, documentation or other information contained in these files, and other content on www.titanicarchive.org are proprietary to Titanic Archive or its licensors unless identified by an Open Access (OA) icon.
Materials identified as OA are either those that Titanic Archive believes to be in the public domain, or those to which the Titanic Archive waives any copyright it might have.
Copyright and Proprietary Rights
For materials identified as "Educational Use Only," copyright and other proprietary rights may be held by individuals or entities other than, or in addition to Titanic Archive.
These materials are made available by Titanic Archive for purposes of preservation and use in private study, scholarship, or research as outlined in Title 17, § 108 of the U.S. Copyright Code.
Subject to certain limitations, there is no copyright infringement by "Fair Use," under Title 17, § 107 of the U.S. Copyright Code, which includes use of www.titanicarchive.org content for the following purposes:
- Personal or Private study
- Non-commercial research
- Academic use
- Criticism and review
Any other use of Titanic Archive content requires the curator's prior written permission. To request permission, please contact us.
If you notice or see any copyright infringement on our website, please contact us and include a filled out version of this form.
Citations
Titanic Archive requires that any given resource made available on www.titanicarchive.org and that is used for personal, private and academic use is referenced appropriately and given a full citation.
To cite materials in the collections, Titanic Archive recommends the Chicago Manual of Style and provides a "Source Reference" section at the bottom of each item in its collection for convenience.
To cite pages of the website as a reference, please use the following citation format:

Non-permitted uses
Other than as expressly permitted by these terms of use, you may not copy, download, reproduce, publish, republish, post, transmit, modify, adapt, translate, manipulate, add to, delete from, adapt, distribute or otherwise use any content in whole or in part, in any medium without Titanic Archive’s prior written permission or without the written permission of the relevant copyright holder. Unauthorized attempts to deny service, upload information, change information or to attempt to access non-public data from this service are strictly prohibited and may be punishable to the full extent of the law.
Titanic Archive Brand
The Titanic Archive brand, logo, and trademark are distinct from the content on the rest of the website. In contrast to media assets and text published on and external to the website, the Titanic Archive brand, logo, and trademark are not Open Access (OA) assets. Titanic Archive retains all rights to brand, logo, and trademark, and these should not be shared inline with content otherwise produced on the site.
Links to Third-Party Sites
On occasion, Titanic Archive will link to external websites for further information or comment. We are not responsible for the content or reliability of external websites, even when we link to them.
Disclaimer of Warranties
The www.titanicarchive.org website and its content are provided on an ‘as is’ and ‘as available’ basis. To the extent permitted by law, Titanic Archive excludes all representations and warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

Jurisdiction
